The FDA and Weight Loss Supplements

In the wake of the Hydroxycut recall, there is a great deal of debate over how much power the FDA has and should have over the weight loss supplement market. On one side, advocates believe that FDA control could have prevented the 1 death, 23 cases of liver damage, 4 cases of seizures and 46 cases of cardiovascular events. On the other hand, supporters believe that Iovate's voluntary recall proves that the supplement market can handle itself.

There are currently only two FDA approved weight loss supplements: Meridia and Alli. However, because the FDA does not control the market, Americans spent $1.67 billion on other supplements in 2007 which could contain ingredients that cause health problems. The ingredient that caused Hydroxycut's issues has still not been identified and could still be on the market.

Class Action Suit Filed in Tennessee

A class action law suit has been filed in Tennessee on behalf of six former Hydroxycut users. If successful, the complaint will keep Iovate Health Sciences Inc from profiting from the sale of Hydroxycut. The suit was filed on May 20 in the United States District Court for the Middle District of Tennessee.

The six Tennessee plaintiffs all purchased $20 to $5000 worth of Hydroxycut products, leading to their development of symptoms now associated with the product. None of the plaintiffs were diagnosed with liver damage, but did suffer abdominal pain, headaches, nausea, vomiting, fatigue and even anxiety attacks among other things.

Hydroxycut Worries

Although Hydroxycut has already injured several people and killed one, the entirety of the supplement's damage may not be done. Many people are feeling the effects of Hydroxycut to a degree that does not require medical attention. However, these people's conditions could feasably worsen in the coming months as the long term effects kick in.

One Colorado couple has reported that Hydroxycut caused some definite side effects that they feel could worsen. The husband reports having taken the supplement for a year leading up to the recall while his wife took it for about 9 months. They both suffered fatigue, soreness and itching but not liver failure. However, it is still possible for their conditions to degrade.

Hydroxycut Liver Damage

Hydroxycut is associated with a risk of severe liver damage. This liver damage has presented itself in several ways so far and could feasibly present itself in other ways as well. Symptoms of liver damage can include jaundice, darkened urine, nausea, vomiting, fatigue, weakness, stomach pains, itching, loss of appetite and light colored stool.

Hydroxycut Exposes Problems with FDA and Dietary Supplements

With Hydroxycut causing medical problems, issues may be coming up that go beyond this one product. Many injuries related to Hydroxycut were reported well before the recall occurred. This has caused some to question why the federal Food and Drug Administration did not pull the product earlier. Unfortunately, the answer to this is a lack of power.

This allows for factors to come together and form the current situation of Hydroxycut. Without authority to regulate dietary supplements, the FDA was unable to pull Hydroxycut from shelves.
