Courts Finish Consolidating Hydroxycut Cases

The Southern District of California has finished consolidating 16 different federal cases from across the country against Iovate Health Sciences, Inc., the makers of Hydroxycut.  The cases were combined because the courts ruled that all 16 of them shared specific questions and concerns about the erstwhile health supplement.  It is believed that by combining the cases, the courts will have more efficient use of information and witnesses.

The cases come from California, Alabama, New Jersey, Florida, Illinois, Louisiana, Massachusetts, Tennessee, and Wisconsin.

Hydroxycut Efficacy Questions Linger

Courts Ask for Consolidation of Hydroxycut Suits

The U.S. Judicial Panel on Multidistrict Litigation has ruled that federal Hydroxycut litigation must be consolidated for pretrial hearings in the District Court for the Southern District of California.  There are at least 16 lawsuits against Hydroxycut's maker, Iovate Health Sciences, in at least 12 different jurisdictions.  According to the U.S. Judicial Panel, the lawsuits are similar enough to justify combining into a multi-district litigation.

All of the different lawsuits allege that Iovate Health Sciences did not properly research its product before releasing it on the market, making them culpable for the injuries and death that have resulted from their product.

The FDA and Supplements

Because of the potential health risks posed by Hydorxycut, there has been some concern about why the FDA did not exercise over the product sooner, or why the recall did not occur until after someone had already died as a result of the product.  Because of the Dietary Supplement Health and Education Act of 1994 (DSHEA), the FDA considers all dietary supplements as food rather than as drugs in terms of regulation.  While the FDA has considerable more control over drugs, it must have proof of complaints before it can take similar actions against food items or supplements.
